In Pennsylvania, what is the difference between a Mechanics LIen and an Enforcemnt of a Civil Judgement?
Q. I had this incompetant Auto repair shop, Bob's Autotorium in Whitaker Pennsylvania, put a new motor in my Dodge Ram. Overpriced, damage to the vehicle and horrible job.. There was a remaining $300.00 on an ending amount of $3,500 which was only to be $2,100 in the beginning. Even though the District Magistrate entered a judgmnt for the amount of $300.00 plus court costs, i refuse to pay it. So, upon doing research as to what rights they have for the enforcement of the Judgement, there is a mechanics lien and a PA Code that relates to the enforcemnt of Judgements which would include a lien or possible sale of property.. Which is it folks? Pennsylvania law is notoriuous for writing contradictory laws, so this is par for the course. … [cont.]

A. There is nothing contradictory. The two concepts relate to two different things. A "mechanic's lien" is a claim against property by someone who was contracted to improve or repair that property. In most states a mechanic's lien against a vehicle allows a mechanic to retain possession of the vehicle until the bill is paid. There are other laws that allow a judgment creditor to enforce collection of his judgment by seizure of property and and its sale by the sheriff or other court officer. The judgment creditor is said to have a judgment lien against the debtor's property until the judgment is satisfied. So, a mechanics lien is against an individual property improved by the mechanic; a judgment lien is against all propoerty of a debtor… [cont.]

Do you have to pay pennsylvania state income tax if you are on Medicaid ?
Q. My Mother is in a nursing home and was approved for Medicaid in November 2007. Prior to November, she sold off all her mutual funds to pay for her long term care. Now, it looks like she needs to pay Pennsylvania state taxes from the mutual fund sales. She has virtually no assets; that is why she is on Medicaid. Doesn't make sense that PA would approve her for Medicaid but now expect her to pay income tax.

A. If one has income that meets the rules for paying taxes then one needs to pay their taxes.

How do I register a trailer in Pennsylvania to drive and use on the road?
Q. I want to use a trailer to haul some things from Pennsylvania to Virginia, but the trailer is not registered. How much does it cost to register in PA to use and travel with inter-state? It is a smaller, two wheeled trailer. Any other information you need, let me know.
Asked by Bennett T - Thu Jun 5 21:32:21 2008 - - 2 Answers - 0 Comments
A. You need to go to your agent, assuming you're registering this for under 2,000lbs, and get an insurance id card for the vehicle that's going to be pulling it. If it's larger than 2Klbs, you need to add it to your policy and get the seperate insurance card for it. Cost to register, well, I don't remember, LOL, but it's not much. As long as you aren't hauling for a fee, there's no charge for interstate.

How do you become a teacher in Pennsylvania when you already have a BA?
Q. I have three semesters of college left, and will be graduating with a degree in English. I'm beginning to think that teaching (high school) might be a good path for me and am wondering what it takes to get certified in Pennsylvania. I'm really confused about the options for becoming certified if I don't have a degree in education (which won't). Can anyone explain it to me?

Does Pennsylvania collect state taxes on unemployment compensation?
Q. I am a contract engineer and a resident of Alabama. During 2007 I worked in, and paid Alabama and Illinois State taxes. I also collected unemployment compensation from the state of Pennsylvania in 2007 as I worked in Pennsylvania the previous year and paid into PA unemployment that year. I claim the unemployment income on my Federal Taxes. Since the only income I had from PA was unemployment income, firstly does Pennsylvania collect state taxes on unemployment income, and if NO, do I even need to file a state return with PA?

A. Hi. Pennsylvania gives the income taxes withheld back if you owe no income tax to Pennsylvania. That commonwealth has a line on the PA-40 wherewith the taxpayer can subtract his unemployment compensation back off. The IRS taxes it; the states allow you to subtract it. You have to file with Pennsylvania to get that money back that you had to pay in to the fund. It's the same with any income tax that Pennsylvania withheld from you.

Where In Pennsylvania would be a good weekend vacation destination in October?

A. October in PA is the most beautiful time of year to visit; days are warm, nights cool and the leaves are breath-taking! I suggest confluence, the Youghiogheny River has various sites around it, a hike/bike trail that stretches from Pittsburgh to Washington D.C. and sometime in October they have a pumpkin fest. It's about an 1 hour to an 1 1/2 from Pittsburgh and you could find a nice cabin or B&B to stay in. Also they have local wineries. P.S. Congrats our 5 year anniversary is in October.

A. federal law - if the employer is covered by FLSA (most but not all are). Pennsylvania has it's own overtime laws which follow federal guidelines for the most part. this site has some FAQ's concerning Pennsylvania's laws on overtime: when dealing with labor laws: the law, local or federal, which provides the most protection or is of the most benefit to the employee is the law that must be followed.

What is the time limit for extradition from Pennsylvania to Virginia?
Q. My friend is being held in a jail in Pennsylvania and after his hearing on Wednesday, the state of Virginia will have the right to have him extradited there. They have to pick him up. What is there time limit to pick him up? My friend said it was ten days and after that they would have to file an extension and the max total is 30 days from the day that they are allowed to pick him up.

A. I think that you are confusing the time limit for the action on the detainer with the order for extradition. He is currently held on a detainer for a warrant of extradition and the courts have a limited amount of time to act on that. Since his court date is Wednesday, the time limit on the warrant is a moot point. The amount of time for extradition is generally set by the judge. On average, they will order that the extradition take place within 30 days. Unless a flight is required, he will probably be picked up in15 days. The courts in Pennsylvania will have to notify the Sheriff's Office in Virginia of the court findings for the extradition process. They will probably sit on it for a few days before faxing it out. A. Dorney Park is famous for Steel Force. This is the one that people travel to Dorney for. Dorney also has Hydra which is the first floorless coaster in PA. If you want other thrill rides you have to ride the Dominator. (I like the down side, not the upside.) This slowly takes you up to the top and the drops you. So fun! Dorney has lots of hills so prepare to walk. If you are getting the combo pass for Wildwater Kingdom that is a good move, it is really hot here right now.

A. I have listed several links that you can check out below. Another things is check with prison ministries as many churches have programs that help ex felons find not only employment but housing and ongoing mentoring support.

What are the rights and remedies of third party, secured lienholders in Pennsylvania?
Q. I would apprecaite any suggestions with regard s to the rights and remedies of third party secured lienholders in Pennsylvania. All the case law I have read deals with monies given to the third party AFTER the sale has taken place. I do not wish for it to go that far, as I would like to STOP the sale. Any suggestions to put a major problem for this primary lienholder?

A. I would suggest engaging an attorney if the amount owed is enough to warrant it.
